Terms and Conditions

BOOKING FEE

A booking fee of stated on your invoice is required to secure the date. Dates are reserved only when the booking fee is paid. This sum will apply towards the contract fee.

TERMS

It is mutually agreed that the following terms and conditions form an integral part of this contract/invoice and that no variation or modification of the contract shall be effective unless accepted by Ryan Paul Troy Photography (also called “the Photographer”) in writing.

CANCELLATION

In the event of the Client canceling a booking for Event photography Ryan Paul Troy reserves the right to charge a cancellation fee in accordance with the following scale:

100% of the agreed fee if canceled within 3 days of the Event date.

50% of the agreed fee if canceled within 7 days of the Event date.

The agreed deposit if canceled at any time after booking.

Should the canceled Event turn out to be a postponement, then subject to availability on a new date, monies other than the booking fee may be applied to the new Event.

In the event of Ryan Paul Troy having to cancel photographing the Event, due to illness, accident or act of God, any fees paid, including the deposit, will be returned to the client unless Ryan Paul Troy is unable provide an alternative photographer from his list of professional contacts.

WEATHER AND/OR DELAYS

Weather permitting, the photographs will be taken as agreed. In the event of inclement weather, the photographer, in co-operation with the Client, will make the necessary changes to the schedule and will do his best to produce coverage of the Event within the time allocated to his. Similarly, when delays occur due to circumstances outside his control, the photographer will stay on beyond the agreed time but may charge a small additional fee for extra time involved.

REQUESTED PHOTOGRAPHS & VIDEO

Ryan Paul Troy will honor requests for specific photographs & video, subject to the following: weather and time permitting; availability and the co-operation of the person(s) concerned.

COVERAGE

Ryan Paul Troy cannot be held responsible for the lack of coverage caused by the members of the Event party not being ready on time, nor by restrictions placed on the photographer by officials of the church, register office or licensed marriage venues or locations planned for other events and shoots, Ryan Paul Troy does not guarantee any specific picture nor to include any specific background, location, props, or arrangement, although every effort will be made to interpret the Client’s wishes. Ryan Paul Troy is limited by the guidelines of the ceremony official or reception site management. The Client agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is the Client’s responsibility. Ryan Paul Troy will offer technical recommendations only.

COLOUR MATCHING and SIZES

Owing to photo-chromatic anomalies caused by a combination of certain dyes and materials, especially in man-made fibers, it is sometimes impossible to record on camera the exact colour of materials as perceived by the human eye. When processing images, Ryan Paul Troy will endeavor to achieve a pleasing overall colour balance based on natural flesh tones. It is understood that some colours may not remain consistent throughout a set of photographs owing to variations in lighting conditions. It is also understood that all photographic printing is undertaken within the technical limitations of the process and that colour may not be identical over the whole range within a subject. The colour balance of prints made at different times or in varying sizes may also be variable. Due to the limitations of computer monitors it is understood that images may appear differently according to the specification of each monitor and that prints will not match images rendered on any computer monitor.

The copyright in all photographs & Videos created by Ryan Paul Troy shall remain his property in accordance with the Copyright, Design and Patents Act 1988. The Client(s) shall have no right to reproduce, nor to authorise the reproduction of, by any means whatsoever, any photographs created by Ryan Paul Troy without his permission. This includes photocopying, scanning into computer, photographing with a film or electronic camera, including a video camera, and producing either a hard copy on paper, film, or similar medium, and recording an electronic image on a computer hard disc, or any tape, disk or other recording medium. Nor is it permitted to transmit or allow to be transmitted such images by cable, radio waves or the internet. The Client(s) hereby acknowledges that infringement of Ryan Paul Troy’s copyright is unlawful and may be a criminal offence. Ryan Paul Troyaccepts no responsibility for the quality and colour reproduced from third party printers of images taken from Copyright free images supplied, due to variations in paper and third-party printing processes and profiles. If photos and video are used without the consent of Ryan Paul Troy on any medium, a £500 fee applies. If unpaid this will be then taken further.

DELIVERY TIMES

Please ask about delivery and busy times, depending on the project this can vary on how long delivery will take.

MODEL RELEASE

The Client hereby grants to Ryan Paul Troy and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client hereby releases Ryan Paul Troy and its legal representatives and assigns from all claims and liability relating to said photographs. Ryan Paul Troy will ask permission from the Client to publish a photograph, and the Client has the right to refuse publishing.

GDPR

As per the new GDPR guidelines from 25th May 2018, we will ask permission of any data used. We use apps such as PayPal, Invoiced and Wix bookings that all comply with the new data guidelines. If you have any questions please don’t hesitate to ask.

Late Payment Charges

Ryan Paul Troy Photographer & Videographer is introducing late payment charges for customers who do not make payments in full and on time.

These revised late payment charges will be applied from 06th April 2018 on the terms set out below.

Late payment charges

If we do not receive a payment in full or as it states in your contract on or before your payment date, you must pay us a late payment charge of £15.

Only one late payment charge will be applied for each month when payments are missed, late or not paid in full under this agreement.

If you miss payments at the same time on two or more agreements you have with us, we will apply only one late payment charge of £15 for that month to the agreement, and £5 per week admin fees, which started earliest in respect of which payment has been missed.

The maximum amount of late payment charges payable for your agreements will be capped at £30 in any consecutive 5-week period and at £50 in any consecutive 13-week period.

Having difficulty making your payments?
We understand that sometimes you may experience an unplanned financial issue that affects your ability to maintain your payments on time. Therefore, if you advise us that you are unable to make your payment before that payment is due and you make a commitment to resolve your account at a later date, we will not apply a late payment charge.

Note: If, however, you break your commitment, by not resolving the account by the agreed date or by not informing us beforehand of any change, a late payment charge will be applied to your account at that time.
